When can a lot owner build his house?

Can a foreign national own a unit at Porto Laiya?

Yes, if the foreigner has dual citizenship, one of which is Filipino. However, Philippine-born individuals who have migrated abroad (for example, U.S. immigrants or Filipinos who acquired U.S. citizenship) may also acquire a lot, but limited to a maximum of 5,000 sqm. in case of urban land, as set out in Republic Act No. 8179.

What are the restrictions given to a lot owner in building his house?

a. Building Height – shall not be more than two storeys high or not more than nine (9) meters from street level to roof apex (Residential lots)

b. Easement

    • Front 3.0 meters
    • Side yard 2.0 meters
    • Rear yard 2.0 meters

c. Materials – shall be strong with the intention of permanency.

d. Cost of Building – for residential lot, housing structure shall be constructed at the cost of at least Five Million Pesos (P5,000,000.00).

Is the price VAT inclusive?

No, price per sqm. is VAT exclusive. A lot is only VAT exempt as long as the value of each property does not go beyond P1,919,500.00.
